The High Court has postponed the plea hearing of Kithuka Musyimi, the main suspect in the killing of a General Service Unit (GSU) officer assigned to State House, after learning that his mental assessment report is not yet ready.
The case was mentioned before Justice Diana Kavedza on Thursday, November 13, 2025. Prosecutors informed the court that the mental evaluation, which must be completed before the suspect can be arraigned on murder charges, is still pending and should be ready within two weeks.
Justice Kavedza underscored the importance of the report, noting that the court cannot proceed until it confirms Musyimi’s mental fitness to stand trial.
“We do not have the mental assessment report. Without it, we cannot establish whether the accused is fit to plead,” she said.
“The matter will be mentioned again on November 27.”
To ensure the suspect has legal representation, the court appointed lawyer Martin Nabende to act on his behalf throughout the proceedings.
The judge further directed that once the report is filed, both the prosecution and defence should be notified ahead of the next mention.
A State counsel leading the prosecution told the court that the assessment is currently being conducted and that efforts are underway to fast-track the process. Musyimi will remain in custody as he awaits the report’s completion.
Musyimi is accused of killing GSU officer Ramadhan Khamisi, who was stationed at State House Gate D along Dennis Pritt Road in Nairobi.
According to investigators, the incident occurred in early October in what authorities described as a rare attack targeting a security officer within one of the country’s most heavily guarded locations.
Court documents indicate that the slain officer was on duty when a man armed with two traditional arrows approached him, disguised as a street dweller.
“The suspect, carrying a blue sack with a bow and arrows hidden inside, moved toward the GSU officer manning the gate,” the documents state.
“He fired two arrows, and the second struck Officer Ramadhan. The suspect was then subdued and arrested.”
Khamisi sustained serious injuries and was rushed to Kenyatta National Hospital, where he died while undergoing treatment.
Investigating officer Inspector Bashir Boya told the court that the weapons used in the attack were recovered at the scene. He confirmed that the suspect was apprehended immediately after the assault and has remained in custody as investigations continue.
